terms of service

these terms apply to anyone who creates a jollygig account or uses the jollygig service. by signing up, you agree to them. if you don't agree, don't sign up.
what jollygig is
jollygig is a team-health product that delivers anonymous pulse surveys to members of a team and surfaces aggregate signal (called personas) to that team's manager. the privacy policy describes the data model in detail.
your account
- you sign in with a magic link sent to your work email. you are responsible for keeping access to that email secure.
- you may not share your account with another person. each individual using the service should have their own account.
- you must be at least 16 years old, or the minimum age required to consent to data processing in your jurisdiction, whichever is higher.
plans, trials, and billing
- every team starts with a 30-day free trial. no card is required to begin the trial. you may cancel at any time during the trial without charge.
- after the trial, the team converts to the plan the manager selected (starter or growth) at the displayed price. annual plans bill once per year; monthly plans bill once per month.
- pricing is flat per team, never per seat. inviting more members does not increase the price.
- we may revise pricing at most once per twelve months, with at least 30 days' notice. existing annual subscriptions keep their current price until renewal.
- payment is processed by stripe. failed payments retry on stripe's default schedule. if a payment is unrecoverable, the account enters a 60-day grace period before suspension.
cancellation and refunds
- you may cancel at any time from the billing settings page. cancellation takes effect at the end of the current billing period; we do not pro-rate.
- if you cancel within 14 days of the first paid charge and have not actively used the product, you may request a full refund.
- account data is retained for 30 days after cancellation, then permanently deleted.
acceptable use
you may not use jollygig to:
- circumvent the anonymity firewall, including by attempting to coerce members to share their individual responses.
- add members to a team without their consent.
- scrape, reverse-engineer, or otherwise extract data beyond what the product surfaces.
- resell, white-label, or sublicense the service without a written agreement.
- use the service in violation of applicable law, including labor, privacy, or anti-discrimination law.
your content
"your content" means the team configuration, action plans, and notes you create. you own it. you grant us a limited license to store and display it back to you and your team. we will not use your content to train machine-learning models. we will not share it with anyone outside your team without your written instruction.
service-level expectations
we aim for 99.5% monthly uptime. we do not currently offer a contractual sla. for incident history and current status, see the status page (linked from the help center).
warranty disclaimer
jollygig is provided "as is." we do not warrant that the service will be uninterrupted, error-free, or that the personas it surfaces will accurately reflect every aspect of your team's wellbeing. the personas are tools for reflection, not diagnoses.
limitation of liability
to the fullest extent permitted by law, our aggregate liability for any claim arising from your use of jollygig is limited to the amount you paid us in the twelve months preceding the claim. we are not liable for indirect, incidental, or consequential damages.
changes to these terms
we may update these terms. material changes will be announced at least 30 days before they take effect, via email and an in-app notice. continued use after the effective date counts as acceptance.
governing law
these terms are governed by the laws of the state of delaware, usa, without regard to conflict of laws principles. any dispute will be resolved in the state or federal courts located in delaware.
